Our role
Propertyvendr is a lead generation platform for property services, owned and operated by 3xrank (Pty) Ltd ("we", "us"). Propertyvendr is not a contractor and does not perform or contract for any work. The platform takes and screens your request and hands it to a licensed contractor on its list. Your contract, pricing, warranty, scheduling and permits are with that contractor. Propertyvendr is not a party to the work contract and is not responsible for the contractor's performance, workmanship or compliance. Complaints about the work go to the contractor and, where applicable, the Contractors State License Board. Propertyvendr may receive a fee from the contractor for the lead; this does not affect the price you are quoted. The contractor is identified to you, with its license number and insurance details, at assignment.
Requests and response windows
A request is an invitation for a contractor to be assigned; it becomes an engagement when the contractor confirms it and, for planned work, when you approve a written scope. Response windows shown on the site are typical road times from Modesto under normal conditions and are quoted as windows, not guarantees. Emergency dispatch depends on crew availability, weather and road conditions, and a confirmed time is given when the request is acknowledged. The emergency line is for active water, fire, storm, mold or biohazard events; other requests are handled through the form. We may decline or cancel a request that is outside the service area, outside the services offered, unlawful, unsafe, or that we reasonably suspect to be fraudulent.
Calls and texts about a request go only to the number you give and only where you asked to be called or texted, and consent to them is not a condition of purchasing any service. Message frequency varies with the request. Message and data rates may apply. Reply STOP to any text to stop them and HELP for help; stopping texts does not cancel a request, which is then handled by the other channel you chose. Consent can also be withdrawn through the Contact page, and withdrawing it does not affect anything already sent.
The contractor and the work contract
All work is performed by a contractor on the Propertyvendr list, holding a current California Contractors State License Board license and the insurance required for the work, to whom your request is handed. Your contract for the work is with that contractor, on its written contract, which you receive with the scope and which contains the disclosures California law requires for the type of work, including its license number, mechanics lien and Contractors State License Board notices where applicable, and any right to cancel. The contractor is responsible for the quality of the work, permits, safety, warranties and compliance with building codes. We check contractors for current license and insurance before adding them to the list and may remove a contractor from it, but we are not a party to the work contract and do not guarantee the work. You may verify any contractor's license with the Contractors State License Board using the number provided at assignment.
Client area
The client area is provided to you and to users you invite, with the roles you set. You are responsible for the accuracy of property information, for the actions of users you invite, and for keeping login credentials confidential. Approvals recorded in the client area by a user with an approval role bind the property owner or association that user represents. We may suspend access for non-payment, misuse or security reasons and will restore it when the reason is resolved. You may export your records at any time.
Scope, pricing and payment
Planned work is priced in a written line-item scope before it begins; changes are priced in written change orders you approve in the client area. Emergency mitigation is scoped on site, confirmed after the site visit, and billed as performed; where a carrier is involved the scope is prepared in the industry-standard estimating format. Invoices are issued through the client area on the terms shown on the invoice. Late payment may carry interest at the rate stated on the invoice, not exceeding the rate permitted by California law. Invoices for the work are issued by the contractor on the terms of its written contract. No one other than that contractor will ask you for payment for the work. Insurance proceeds are your responsibility to pursue; an assignment of benefits is only made if you sign one with the contractor.
Your content and uploads
You keep ownership of the descriptions, photos and documents you submit and grant us a licence to use them to perform and document the request and to keep the record for the retention period in the Privacy Policy. We do not sell the personal information in a request and do not share it for cross-context behavioural advertising. You confirm you have the right to submit them and that they do not contain information about other people that you are not entitled to share. We may remove content that breaches these terms.
Acceptable use
- Do not submit false, misleading or fraudulent requests, or requests for property you are not authorised to act on.
- Do not use the site to solicit contractors or clients for other platforms, scrape content, or probe or interfere with the site or the client area.
- Do not upload malicious files or content that is unlawful, defamatory or infringing.
- Do not use the emergency line for anything other than an active loss.
Disclaimers
The site and the platform are provided as is. To the fullest extent permitted by law we disclaim all warranties about the site, the platform and the information on it, including implied warranties of merchantability and fitness for a particular purpose. Information about building conditions, weather, flooding, insurance coverage, permits and regulations on the site is general and is not engineering, legal, insurance or financial advice; verify it against the source cited and take professional advice for your property. Warranties for work performed are given in the work contract. Insurance coverage decisions are made by your carrier.
Limitation of liability
To the fullest extent permitted by law, our total liability to you for all claims arising out of the site, the platform or a request in any twelve-month period is limited to the platform fees you paid us in that period or, if none, to one hundred dollars, and we are not liable for indirect, incidental, consequential, special or punitive damages, or for loss of rent, business, profits or data. Nothing in these terms limits liability that cannot be limited under California law, including for death or personal injury caused by negligence, for fraud, or under consumer protection statutes that cannot be waived. Claims about the performance of the work are made under the work contract.
Disputes and governing law
These terms are governed by the laws of the State of California. Before starting any proceeding you agree to give us written notice of the dispute through the Contact page and to try in good faith to resolve it for thirty days. Disputes that are not resolved are brought in the state or federal courts located in Stanislaus County, California, and you consent to their jurisdiction. Either party may bring a qualifying claim in small claims court instead. Nothing in this section affects any right you have under the Contractors State License Board complaint process or the work contract.
